- Oversight: To verify compliance, Lady by Day will engage in periodic self-audits. In the course
of this self-assessment, Lady by Day
will confirm that this Privacy Policy is accurate, comprehensive, prominently
displayed, completely implemented, accessible and conforms to accepted
privacy policy principles. We will also verify that appropriate employee
training and internal procedures for periodically conducting objective
reviews of compliance are in place.
- Enforcement: Any dispute relating in any
way to your visit to ladybyday.com or to Lady by Days Privacy Policy, privacy practices, or the
implementation thereof shall be submitted to confidential arbitration
in the Commonwealth of Virginia; except that, to the extent you have in any manner violated
or threatened to violate Lady by Day's
intellectual property rights, Lady by Day
may seek injunctive or other appropriate relief in any state or federal
court in the Commonwealth of Virginia, and you consent to exclusive jurisdiction
and venue in such courts.
Arbitration under this agreement shall be conducted
under the rules then prevailing of the American Arbitration Association.
The arbitrator's award shall be binding and may be entered as a judgment
in any court of competent jurisdiction. To the fullest extent permitted
by applicable law, no arbitration under this Agreement shall be joined
to an arbitration involving any other party subject to this Agreement,
whether through class arbitration proceedings or otherwise.
